We may modify, suspend, or discontinue any part of the Foodeks platform at any time without notice.
3.5 LICENSE TO ACCESS THE SITE
Foodeks grants you a limited, revocable, non-exclusive, non-transferable license to access and use the platform solely for your personal, non-commercial use.
3.6 YOUR CONDUCT
You agree to use the Foodeks platform in compliance with all applicable laws and regulations. You are solely responsible for your conduct and any data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links that you submit, post, and display on the Foodeks platform.

By submitting, posting, or displaying any data, text, information, usernames, graphics, images, photographs, profiles, audio, video, items, and links on the Foodeks platform, you grant Foodeks a non-exclusive, worldwide, royalty-free, sub-licensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the submissions in connection with the platform and Foodeks’ business, including without limitation for promoting and redistributing part or all of the platform in any media formats and through any media channels.

Foodeks does not guarantee the quality, safety, or legality of the products or services provided by the restaurants and vendors listed on our platform. Foodeks is not responsible for any losses, damages, or other liabilities arising from your use of the Foodeks platform.
3.11 THIRD-PARTY BUSINESSES
Foodeks may provide links to websites or applications operated by third-party businesses. We are not responsible for the content, availability, or actions of these websites or applications, and your use of them is at your own risk.
3.12 LOSSES
Foodeks is not responsible for any losses you may incur as a result of using our services, including but not limited to loss of income, business, revenue, or profits, or any other form of economic loss.
3.13 AMENDMENTS TO CONDITIONS OR ALTERATIONS OF SERVICE AND RELATED PROMISE
Foodeks may amend these terms and conditions at any time, and your continued use of our services constitutes your acceptance of any such amendments. We may also alter or discontinue any part of our services at any time.

- CONDITIONS OF SALE (BETWEEN SELLERS AND CUSTOMERS)

When you make a purchase through our platform, a contract is formed between you and the seller. Foodeks is not a party to this contract and is not responsible for any issues that may arise between you and the seller.

5.3 UNSUCCESSFUL OR FAILED DELIVERIES

Delivery times may vary based on a variety of factors, including but not limited to, traffic and weather conditions. Foodeks will make every effort to deliver orders in a timely manner but cannot guarantee exact delivery times.
9.3 Unsuccessful or Failed Deliveries
In the event of an unsuccessful or failed delivery, Foodeks will attempt to contact the customer to reschedule the delivery. If the customer is unavailable, the order may be cancelled, and a refund may be issued in accordance with our refund policy.
9.4 Wrong Order, Missing Items, Defective Goods
If you receive a wrong order, missing items, or defective goods, please contact Foodeks customer service within 24 hours of receiving the order.
9.5 Order Pick-Up
If you choose to pick up your order, please do so within the designated pick-up time. Foodeks is not responsible for any orders that are not picked up within the designated time.

Vendor delivery is subject to the terms and conditions set by the vendor. Foodeks is not responsible for any issues or disputes that arise between the vendor and the customer.

TAXES

Rider Tips
- The rider tip is optional, and any tips paid to the rider are entirely at the discretion of the customer.
STOCK AVAILABILITY
- Foodeks makes every effort to ensure that all items are in stock, but we cannot guarantee the availability of any item. In the event that an item is not available, Foodeks will contact the customer to offer a replacement or refund.
